Waiver and Release of Liability Agreement
I hereby enroll for Brazilian Jiu Jitsu training classes at Wise JiuJitsu LLC at 3637 N. HWY 77 Ste. B Waxahachie, TX. 75165.
In consideration for being permitted to participate in Brazilian Jiu Jitsu training and all other related activities conducted by Wise JiuJitsu LLC. I for myself, my spouse, legal representatives, heirs and assigns, volunteers and employees, other participations (the releases), and if applicable owners and lessors of the premises on which the activities take place, for all liability (whether known or unknown) to me, spouse, legal representatives, heirs and assigns for any loss damage and any claims of damages resulting therefrom, on account of injury to my person, property, even injury resulting in my death, whether caused by the negligence and gross negligence of the release or otherwise while I am in said of Brazilian Jiu Jitsu training or related activities.
Furthermore, I agree and covenant not to institute prosecute, or allow to be instituted or prosecuted or in any way to aid the institution or prosecution of any lawsuit or claim against Wise JiuJitsu LLC at 3637 N. HWY 77 Ste. B Waxahachie, TX. 75165. I hereby assume full responsibility for the risk of bodily injury, death, or property damage due to negligence of the release of otherwise while in or upon Wise JiuJitsu LLC or while participating in Brazilian Jiu Jitsu. I agree to indemnify the releases and hold them each harmless from any loss, liability, damage, or cost they may occur due to my presence at Wise JiuJitsu LLC premises whether caused by the negligence of the release or otherwise. I will indemnify, save, and hold harmless each of the releases from any litigation expense of attorney fees, loss liability, damage, and cost of any releases may incur as a result of such claim. I warrant I will not cause or attempt to cause any injury to myself or any other participant, instructor, or spectator. I warrant that I have consulted a licensed physician that I am in good health and that there are no physical or mental defects that would endanger my well-being or that of other participants or instructors.
I represent and warrant that I have carefully read the preceding release and waiver understand the contents thereof sign this release as my free act and further agree that no oral representation, statement or inducements apart from the preceding written agreement have been made.
Addendum to Waiver and release of Liability Agreement for Participation by Minors
The Undersigned parent and/or guardian HEREBY REPRESENTS that he/she is acting in such capacity, has consented to his/her child’s or ward’s participation in the Activities, and has agreed individually, and on behalf of the child or ward, to be bound by the terms of the Wavier and Release of Liability Agreement. For the avoidance of double, the undersigned agrees to INDEMNIFY (including for reasonable attorney fees and costs) and HOLD HARMLESS the RELEASED PARTIES to the extent an action is commenced in respect of a RELEASE CLAIM in connection with the child’s or ward’s participation in the Activities and liability is imposed based on the child’s or ward’s lack of the capacity to enter into a contract with Wise JiuJitsu LLC.
Marketing Release
Photographs and Video content, Waiver Indemnity and Release: I hereby grant permission to Wise JiuJitsu LLC and its representatives to take photographs or video of me and to make recordings of my voice. I further grant Wise JiuJitsu LLC and its representatives the right to reproduce, use exhibit, display, broadcast distribute, and create derivative works of the images and recordings in any media now known or later developed. I acknowledge that Wise Brazilian Jiu Jitsu owns all rights to the image and recordings.
